Be sure to plan enough ice, firewood, charcoal, and groceries for your visit! There are plenty of grocery pickups on the near downtown Gaylord and some services over delivery for a fee. Short-Term Rental Agreement The Birchwood Lodge – Gaylord, Michigan Guest Responsibility Statement The Birchwood Lodge is a privately owned home located in a quiet Northern Michigan lake community. We welcome guests who appreciate nature, respect neighbors, and treat the property as they would their own home. By booking this property, Guest acknowledges responsibility for the care of the home, safety of their party, and respectful behavior throughout the stay. Property Information This Short-Term Rental Agreement ("Agreement") is entered into between K&B Management Consulting LLC ("Owner") and the booking guest ("Guest") for use of the property known as The Birchwood Lodge, located at: 9219 Tall Birch Road Gaylord, Michigan 49735 By confirming a reservation through any booking platform or direct website booking, Guest agrees to the terms outlined in this Agreement. Eligibility The primary booking Guest must be at least 25 years of age and must occupy the property for the entire reservation period. Maximum Occupancy Maximum occupancy is 16 guests, unless otherwise approved in writing by Owner. Only the number of guests listed on the reservation may stay overnight at the property. Owner reserves the right to decline bookings from local guests or reservations that appear to violate house rules. Unauthorized guests or exceeding occupancy limits may result in termination of the reservation without refund. Security Deposit & Damage Responsibility Owner reserves the right to charge the payment method on file for: • Property damage • Missing items • Excessive cleaning • Rule violations Guest agrees to be financially responsible for any damage to the property, furnishings, equipment, or surrounding property caused by Guest or members of Guest's party. Guests must report any damage or malfunction promptly. Cancellation Policy Cancellations must follow the policies of the booking platform used. Travel insurance is recommended. Weather & Force Majeure Owner is not responsible for cancellations or travel disruptions due to: • Weather events • Road closures • Power outages • Natural disasters • Other circumstances outside Owner's control Travel insurance is recommended. Guest Conduct & House Rules No Parties or Events Parties are not permitted. Small gatherings or weddings may occur only with prior written approval, a separate event agreement, and applicable fees. Unauthorized events may result in immediate termination of the stay without refund. Commercial Use The property may not be used for commercial purposes including: • Photo shoots • Video productions • Business meetings • Events or promotions Written approval from Owner is required. Smoking Policy Smoking or vaping of any substance, including marijuana, is not permitted inside the home. Smoking outdoors must occur away from the structure and not on the deck. Violations may result in a $250 cleaning fee plus remediation costs. Noise Quiet hours are 10:00 PM – 8:00 AM. Noise monitoring devices may be used to ensure compliance. Illegal Activity Illegal activity of any kind is strictly prohibited. The property maintains a zero-tolerance policy for illegal behavior, unauthorized events, and unregistered guests. Violations may result in immediate termination of the stay without refund. Good Neighbor & Township Compliance Policy The Birchwood Lodge is located in a residential lake community. Guests agree to respect neighbors and comply with all local township ordinances, lake regulations, and community standards. Guests agree to: • Respect quiet hours • Avoid excessive noise or disruptive behavior • Park only in designated areas on the property • Respect neighboring properties and private docks • Follow local fire, boating, and lake safety regulations Repeated complaints from neighbors or violations of township regulations may result in termination of the reservation without refund. Guests are responsible for any fines or penalties issued due to their conduct. Guest Visitor Responsibility Guest is responsible for the conduct and safety of all persons on the property, including visitors. Visitors must comply with all house rules. Guest assumes full responsibility for injuries, damages, or incidents involving visitors during the reservation period. Pet Policy Dogs are permitted only with prior approval. Pet Fee: $40 per pet per night (maximum $250 per stay) Pets may not be on furniture or linens. Service animals are permitted in accordance with applicable law and are not subject to pet fees. Security Cameras & Monitoring Exterior security cameras are installed for safety and occupancy monitoring. Camera locations include: • Front entry door • Driveway • Chalet exterior facing the lake • Exterior patio facing the lake • Rear deck entry There are no interior cameras. By booking the property, Guests acknowledge and consent to exterior monitoring. Cameras are used solely for safety, security, and verification of occupancy and house rule compliance. Lake & Waterfront Safety Policy Big Chub Lake provides opportunities for swimming, kayaking, boating, fishing, and winter ice activities. Guests acknowledge these activities involve inherent risks. Children must be supervised at all times near: • The lake • The dock • The shoreline • Watercraft • The hot tub or sauna The property is not child-proofed and no lifeguard is present. Guests assume full responsibility for supervision of minors. Dock & Watercraft Use Use of the dock, kayaks, paddle boards, floating island, and other water equipment is provided as a courtesy. All water activities are at Guest’s own risk. Guests agree to: • Wear life jackets when using watercraft • Use equipment responsibly • Operate equipment only during daylight hours • Avoid use during inclement weather • Return equipment clean and properly stored Owner assumes no liability for accidents occurring on the dock, in the water, or while using provided equipment. Dock Jumping & Diving Policy Water depth near the dock and shoreline may vary due to seasonal lake levels and natural conditions. Diving or jumping from the dock, shoreline, or floating island is strongly discouraged and performed entirely at Guest's own risk. Owner does not guarantee water depth or underwater conditions. Guest assumes full responsibility for injuries resulting from diving, jumping, slips, or falls near the dock or shoreline. Alcohol & Water Activity Responsibility Consumption of alcohol or other substances may impair judgment and increase the risk of injury. Guests are strongly discouraged from swimming, boating, or operating watercraft while under the influence. Owner assumes no responsibility for accidents or injuries related to impaired activity. Ice Conditions Owner does not monitor or verify lake ice thickness. Ice conditions may change rapidly. Guests assume all risks associated with: • Ice fishing • Walking on the lake • Snowmobiling • Any activity conducted on frozen surfaces Recreational Liability Waiver Guests acknowledge that recreational activities including: •Swimming • Kayaking • Paddle boarding • Dock use • Sauna use • Hot tub use • Ice activities •Watercraft use powered or unpowered of any kind • Outdoor recreation involve inherent risks that may result in injury, illness, or death. By entering the property, Guest voluntarily assumes these risks for themselves and members of their party. Owner shall not be liable for accidents, injuries, drowning, slips, falls, or recreational incidents occurring on the property. Hot Tub Rules • No diving or jumping in the hot tub • Shower before use • No glass containers nearby • Children must be supervised • Follow recommended soak times Use of the hot tub is at Guest’s own risk. Guest Access

You will have complete access to the entire property through three separate structures. The pole barn garage during the winter and spring seasons will be occupied for storage needs. One utility closet with storage by the main systems to the house will remain locked. Otherwise the Chalet and entire house are yours to enjoy. The double concrete parking pads out front on the double lot allow for ample parking of up to 4-6 vehicles depending on size. There is extra parking down the street near the neighborhood entrance. A public boat launch allows access for your private watercraft to our dock located on site. Thank you!
